Definitions

Any term used in these terms and conditions will have the meaning as set out below:

β€œ91ΑΤΖζ” β€œWe”, β€œUs” or β€œOur” means 91ΑΤΖζ
β€œYou”, β€œYour” or β€œApplicant” means the applicant
β€œHome Institution” means the institution where You are currently enrolled
β€œCourse Fee” means the fee for Your chosen Course as set out in appendix 2 Course Fees
β€œAdministration Charge” means the fee payable if You cancel Your place of the Course within the Cancellation Period
β€œC΄Η³ά°ω²υ±π” means the Course of study at 91ΑΤΖζ
β€œCancellation Period” means the cancellation deadlines as set out in clause 4
β€œC΄Η²Τ³Ω°ω²Ή³¦³Ω” means the legally binding contract between Us and You for the provision of the Course in accordance with these terms and conditions and any Offer made to You.
β€œWritten” or β€œWriting” means and form of written communication, including emails
β€œO΄Ϊ΄Ϊ±π°ω” means an invitation to enter into contractual relations with 91ΑΤΖζ, consisting of the Written Offer sent to the named Applicant setting out the details of their Course and the Course Fee payable.
β€œCourse Information” means the information set out in the international summer school brochure in Appendix 1 of this agreement
β€œInternational Summer School” means the International Summer School offered by 91ΑΤΖζ
β€œInternational Office” means the International Office at 91ΑΤΖζ

1. Agreement with 91ΑΤΖζ

1.1. The purpose of these terms and conditions is to set out the basis of Your relationship with 91ΑΤΖζ when You apply for a 91ΑΤΖζ summer school Course.

1.2. Your Contract agreement with 91ΑΤΖζ is made up of these terms and conditions, Your Offer, the Course Information and full payment of the Fees as set out in appendix 2 and before You accept any Offer from us

1.3. Please read these terms and conditions carefully before You submit Your application to Us. These set out the terms of the contractual relationship between You and Us and includes important information such as refunds and insurance.

1.4. 91ΑΤΖζ is a higher education corporation. Our registered address is currently Curzon Building, 4 Cardigan Street B4 7BD, although it may be updated from time to time.

1.5. You can contact Us by Writing to us by email at summerschool@bcu.ac.uk.

1.6. If We contact You during the admissions process We will do so by Writing to You at the email address You provided to Us in Your application.

1.7. Your application form will be a request by You to Us to be considered to attend the Course in accordance with these terms and conditions.

1.8. No agreement will be or is effective in relation to Your attendance on the Course until after We have provided You with Written Offer of Your place on the Course and after You have, in each case within any timescales set out in the Offer:

ΜύΜύΜύΜύ1.8.2. fulfilled any conditions of that Offer; and

ΜύΜύΜύΜύ1.8.3. Paid the Course Fee payable in accordance with any instructions in the Offer and these terms and conditions.

2. Admissions

2.1. Applications for enrolment on a Course must be made using the online application form.

2.2. When completing the online application, please ensure that You read, understand and agree to these terms and conditions.

2.3. All Applicants must be 18 years of age or over and must be current university students.

2.4. Admission decisions are made by 91ΑΤΖζ at its sole discretion in accordance with the entry criteria set out in international summer school brochure in Appendix 1 of this agreement.

2.5. We are under no obligation to offer You a place on the International Summer School, and reserve the right to refuse to offer any person a place on the International Summer School for any reason whatsoever (including, without limitation, a person or any institution at which they are a student owing money to 91ΑΤΖζ).

3. Fees

3.1. The completed application form and the full required Course Fee should be submitted to the International Office no later than 30 April 2025 through the online application portal

3.2. Your Offer on the Course cannot be secured until full payment is received.

3.3. Your Course Fee includes

ΜύΜύΜύΜύ3.3.3. Birmingham airport pick up and drop off

ΜύΜύΜύΜύ3.3.5. Programme of social events

ΜύΜύΜύΜύ3.3.6. International Summer School t-shirt.

3.4. Course Fees include VAT.

4. Cancellation, Non-Attendance and Refunds

4.1. If You wish to withdraw Your enrolment on the course, Your request must be made in Writing to Us by emailing summerschool@bcu.ac.uk.

4.2. You may cancel Your enrolment on the Course for any reason up to 14 days after You receive an email confirming that We have received Your Course Fee and accepting Your enrolment on the Course. During this period, You will be entitled to a full refund. You should send your cancellation to summerschool@bcu.ac.uk and confirm clearly that it is a cancellation notice.

4.3. If You wish to withdraw Your enrolment on the Course after the initial 14-day period You may do so up to 8 weeks before the start of Your Course and You will be entitled to a full refund, minus an administration charge of Β£50.

4.4. If you wish to withdraw Your enrolment on the Course less than 8 weeks before Your Course starts, We reserve the right to retain Your full Course Fee. However, if Your visa is refused before the summer school starts, We will refund You the Course Fee, minus a Β£50 administration charge.

4.5. Non-attendance due to illness, or for personal or professional reasons does not confer the right to refunds or transfers.

5. Credit Transfer

5.1. We offer two types of summer school programmes, credit bearing and non-credit bearing (practice-based). Please see our website for more information. However, it is up to Your Home Institution to decide how much credit is awarded. We can provide the programme specification, and any other additional information required by Your Home Institution. However, We hold no responsibility for how Your Home Institution decides to award credit nor do We have any liability in relation to the same. A minimum level of English language competence is needed for the credit bearing programme. If You are unable to demonstrate the required competence in the English language You are still welcome to attend the Course on a non-credit bearing basis. Upon successful completion of the Course, You will be awarded a non-credit bearing certificate of attendance.

6. Student Conduct

6.1. You are expected to conduct yourself in a professional manner at all times and to recognise the other students also require support and assistance.

6.2. If You are persistently disruptive or any disruption or conduct is of a sufficiently serious level, We reserve the right to issue You with a sanction in line with our Student Disciplinary Policy. If Your conduct does not improve following these warnings, We reserve the right to remove You from the Course at any point.

6.3. You understand that should You have legal or financial problems whilst in the UK, You will be solely responsible for dealing with these matters personally. 91ΑΤΖζ cannot provide any personal, legal or financial assistance.

6.4. You agree to comply with the 91ΑΤΖζ policies and procedures in time from time to time, including, but not limited, to those in relation to equality, health and safety, data protection, intellectual property and system/computer use. In connection with these terms and conditions, both You and We agree to keep to, and to each other keeping to, the Bribery Act 2010, the Modern Slavery Act 2015, the Equality Act 2010, the Counter-Terrorism and Security Act 2015, 91ΑΤΖζ’s Code of Practice on Freedom of Speech on Campus (as amended from time to time), 91ΑΤΖζ’s prevent duty and all related laws, regulations and codes.

7. Insurance & Costs

7.1. You are required to have adequate and comprehensive insurance for the duration of Your stay in the UK and during any period of travel. This insurance should, as a minimum, provide adequate cover for injury, illness, medical issues, hospitalisation, travel delays, loss of property, health and safety concerns, government restrictions, pandemic/epidemic, cancellation fur to unforeseen circumstances or other related losses.

7.2. You accept that no part of the Course Fee goes towards payment of such insurance and that 91ΑΤΖζ has no obligation to provide such insurance. Travel to the UK, visa costs, and other personal travel and living expenses are not included in the Course Fee.

7.3. We are not responsible and expressly exclude liability for any loss or damage to your property. You should insure against such risks as appropriate.

8. Course Material and Service and Limitations on Our Liability

8.1. Compliance with the requirements set out in clause 1.8 entitles You to the services outlined in the international summer school brochure in relation to Course(s), and the services set out in clause 3 above, as well as the available College facilities necessary to attend the Course. Unless otherwise indicated, the Course Fee does not include any other services including but not limited to subsistence, health insurance, travel costs, or any other costs that might arise prior to or during the Course. If a service or facility is not explicitly included in the Course Fee, then it should be presumed not to be included.

8.2. Every effort is made to ensure that all information relating to the Course is correct at the time of advertisement and 91ΑΤΖζ will seek to deliver the Course in accordance with the description provided. However, there may be situations in which it is desirable or necessary to 91ΑΤΖζ to make reasonable changes in Course provision, either before or after enrolment these may include

ΜύΜύΜύΜύ8.2.1. Reasonable changes to the timetable, location or academic staff specified for a Course.

ΜύΜύΜύΜύ8.2.2. Reasonable changes to the content and syllabus of a Course when necessary.

8.3. We will make every effort to provide the Course that You signed up for. However, in the event that we have to make changes to the Course content, venue of the Course, Course tutor we will let you know as soon as possible. Where the changes are significant and adversely change the nature of the Course You originally purchased then You will have the right to cancel Your enrolment on the Course and We will provide You with a full refund of the Course Fee.

8.4. The 91ΑΤΖζ International Summer School is taught in the English language. You should therefore be proficient in English and at least to the minimum standard We set from time to time (which will normally be by reference to the International English Language Testing System). We have no responsibility to You if You are not sufficiently proficient and fail to participate fully in the 91ΑΤΖζ international summer school programme as a result.

8.5. You will be solely responsible for determining whether the 91ΑΤΖζ International Summer School programme is sufficient and suitable for your needs. 91ΑΤΖζ does not provide any guarantee in respect of the standard of your abilities on completion of the 91ΑΤΖζ International Summer School programme. You will provide us with all information reasonably requested by the 91ΑΤΖζ in connection with the relevant the 91ΑΤΖζ international summer school programme.

9. Visa Requirements

9.1. If You require a visa to participate in the 91ΑΤΖζ International Summer School, it is Your responsibility to obtain such a valid visa to travel and study in the UK for the Course. You agree that You will fully comply with any visa conditions applicable to You whilst You are in the UK. For more information, please refer to the Home Office Website.

9.2. It is Your responsibility to determine how far in advance You need to apply for a visa and to allow sufficient time to obtain Your visa. 91ΑΤΖζ is not responsible for any failure by You in obtaining the correct visa enabling you to participate in the international summer school and expressly excludes liability for any loss or damage incurred by you in connection with any such failure.

9.3. If there is any suspicion of potential fraud, inaccurate information or misleading statements being made in relation to the application, visa or any enrolment process, then We will have the right to terminate the opportunity and this Contract immediately and withhold a relevant amount of the Course Fees related to any costs incurred by the 91ΑΤΖζ at that point in time.

10. Intellectual Property

10.1. All materials provided by 91ΑΤΖζ in relation to the summer school (and any intellectual property rights in the same) are and remain the property of 91ΑΤΖζ or the relevant third party in respect of third-party IP. You indemnify 91ΑΤΖζ on a continuing basis in relation to any loss suffered by 91ΑΤΖζ as a result of any breach of this Intellectual Property Clause 10.

10.2. Materials include but are not limited to all documentation or information provided by 91ΑΤΖζ in relation to the summer school, including but not limited to information provided on the 91ΑΤΖζ website, within the international summer school brochure, offer letters, course and reading materials.

10.3. Any use of such materials and documentation that is not for the purpose of the summer school is not permitted without the prior Written approval of 91ΑΤΖζ.

10.4. You must not use any such materials provided by 91ΑΤΖζ for any other purpose than the ones set out in these terms and conditions. Explicitly, use is not permitted for:

ΜύΜύΜύΜύ10.4.2. As an official view or opinion of 91ΑΤΖζ.

ΜύΜύΜύΜύ10.4.3. Presenting as if it were Your own intellectual property.

ΜύΜύΜύΜύ10.4.4. Sharing information with others outside of the University.

ΜύΜύΜύΜύ10.4.5. Uploading information to any external website or file sharing system.

10.5. Ownership of any intellectual property that You create during the Course will be determined in accordance with 91ΑΤΖζs policy relating to intellectual property created by students.

10.6. Use of the 91ΑΤΖζ brand, name and or logos is not permitted without prior agreement of 91ΑΤΖζ.

11. Complaints

11.1. If there is a problem with any of the services provided to You during Your time enrolled on Course. You can submit a complaint to Us in line with the student complaint procedure.

11.2. If You have any issues with the application process, You can contact summerschool@bcu.ac.uk.

12. Force Majeure

12.1. We shall not be liable for any failure or delay in the performance, in whole or part, of any of Our obligations arising from or attributable to acts, events, omissions or accidents beyond Our reasonable control, including - but not limited to - strikes, lock-outs or other industrial disputes (whether involving Our workforce or the workforce of any other party), act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, pandemics, epidemics or other outbreaks of disease or infection, failure in the public supply of electricity, heating, lighting, air conditioning or telecommunications equipment.

13. Limitation of Liability

13.1. Nothing in these terms and conditions will limit or exclude the liability of 91ΑΤΖζ for

ΜύΜύΜύΜύ13.1.1. Death or personal injury arising from our own negligence; or

ΜύΜύΜύΜύ13.1.2. Fraud or fraudulent misrepresentation; or

ΜύΜύΜύΜύ13.1.3. In respect of a liability not lawfully excluded or restricted.

13.2. In all other cases Our total liability to You for any breach of these terms and conditions is limited to the amount of the Course Fee paid by You to Us.

13.3. Additionally, Our liability to You with respect to the provision of a Course, the cancellation, postponement, or amendment of the Course, any negligence, any breach of these terms and conditions, or arising in any way out of connection with the subject matter of these terms and conditions, will not extend to:

ΜύΜύΜύΜύ13.3.2. Any loss of profits either directly or indirectly even if We have been advised of the possibility of those losses or they were within Our contemplation

ΜύΜύΜύΜύ13.3.3. Any costs or expenses incurred by any person or organisation in connection with travel, accommodation, reservations, or other arrangements.

14. Data Protection

14.1. 91ΑΤΖζ will use Your personal data in accordance with its data protection policy and privacy notice for students.

15. Disclaimers

15.1. 91ΑΤΖζ reserves the right to withdraw any advertised programme, for which the recruited number of students is so low that it is not possible to deliver an appropriate quality of education. Where a Course is withdrawn by Us in these circumstances We will provide You with a full refund. For further information, please contact the summer school team at: summerschool@bcu.ac.uk.

16. Variation

16.1. 91ΑΤΖζ reserves the right without prior notice at any time to alter or amend the whole or any of these terms and conditions. Each of the provisions of these terms and conditions is severable from the others and any provision which is illegal invalid or unenforceable shall be severed from the others without affecting or impairing the remainder of these terms conditions.

17. Governing Law

17.1. These terms and conditions and any dispute or claim arising out of or in connection with its subject matter of formation (including non-contractual disputes or claims) will be governed by and construed in accordance with the laws of England and Wales and You irrevocably submit to the exclusive justice of the English Courts.

17.2. If a court finds any part of these terms and conditions illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately.

18. Third Party Rights

18.1. No third party has any rights under these terms and conditions. The contractional agreement is between You and Us and no other person shall have any rights to enforce any of its terms.
